The Petitioner had earlier approached the Calcutta High Court in W.P. (A) 28856/2025, challenging the communication dated 27th November, 2025 issued by Respondent No. 1 concerning the extension of the Petitioner's term as Registrar. In the said proceedings, the Calcutta High Court, by order dated 8th January, 2026, directed Respondent No. 2 to consider and decide the Petitioner's representation after affording an opportunity of hearing and to pass a reasoned order thereon. According to the Petitioner, the impugned decision dated 15th February, 2026 is not issued in compliance with the Court's direction and is in fact in violation thereof. Be that as it may, the Respondents have raised a preliminary objection to the maintainability of the present proceedings. They contend that since the impugned action arises out of directions issued by the Calcutta High Court, the Petitioner should approach the said Court. 3.

In view of this objection, Mr. Sandeep Kumar Mahapatra, counsel for the Petitioner, on instructions, seeks leave to withdraw the present petition with liberty to approach Calcutta High Court in respect of the cause of action forming the subject matter of the present petition. 4.

Leave and liberty as prayed for are granted.
