This application has jointly been filed by the parties under Order XXIII Rule 3 CPC for disposing of the present appeal in terms of the settlement entered into between the parties.

The present appeal has been filed by the Appellants against the Order dated 07.11.2022, passed by the learned District Judge in CS (COMM.) No.248/2021, passing a money decree in the sum of Rs.9,27,249/- along with pendent-lite and future interests @ 7% per annum in favour of the Respondent herein.

It is stated that during the pendency of the present appeal, the parties have entered into a settlement. agreed to pay Rs.8,50,000/- to the Respondent towards full and final settlement of all claims.

Today, a Demand Draft dated 23.04.2025, drawn on HDFC Bank for an amount of Rs.8,50,000/-, has been handed over by the learned Counsel for the Appellant to the learned Counsel for the Respondent. Learned Counsel for the Respondent has accepted the said DD towards full satisfaction of the decree.

In view of the above, the application is allowed and the Appeal is disposed of, along with the pending applications, if any.
