1. This is a joint application filed by the parties with a prayer that the decretal amount deposited by the appellant in terms of this Court's order dated 23.05.2023, be released in favour of the respondent.

2. Learned counsel for the parties submit that during the pendency of the appeal, the parties have arrived at an amicable settlement on 17.09.2024 before the Delhi Mediation Centre, Karkardooma Courts, Delhi. They, therefore, pray that the appeal be disposed of in terms of the settlement dated 17.09.2024 by directing release of the decretal amount deposited by the appellant in favour of the respondent.

3. Having perused the said settlement agreement, a copy whereof has been annexed with the application, the same is allowed and the appeal is disposed of in terms of the aforesaid settlement agreement dated 17.09.2024. Further, the Registry is directed to release the decretal amount deposited by the appellant along with interest accrued thereon The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. in favour of the respondent through counsel.

4. At this stage, learned counsel for the appellant prays that taking into account that as the parties have settled the matter before the Mediation Centre, the court fee paid by the appellant be refunded.

5. Considering the fact that the parties have arrived at a settlement after the matter was listed before this Court on more than 12 occasions, we direct that 75% of the court fees be refunded to the appellant.

6. The application stands disposed of in the aforesaid terms. RFA(COMM) 38/2023

7. In the light of the orders passed hereinabove, the appeal stands disposed of.
