The learned counsel appearing on behalf of the petitioner submits that he has instructions to withdraw the present petitions with liberty to approach the learned DRT by way of an appeal under Section 17 of the SARFAESI Act, 2002.

He submits that the benefit of the period spent before this Court may also be granted to the petitioner for seeking condonation of delay. 3.

In view of the above, the writ petitions alongwith pending applications are dismissed as withdrawn with liberty as aforesaid. 4.

In the event the petitioner files an appeal under Section 17 of the SARFAESI Act, 2002 the learned DRT may consider the prayer for condonation of delay in preferring the appeal in accordance with law having regard to the fact that the petitioners were prosecuting the present writ petitions before this Court.

Needless to say that it shall be open to the respondent/bank to raise objection as to the limitation.
