Status Report has been filed today on behalf of the State. Same be taken on record.

Bail Application under Section 483 BNSS has been filed on behalf of the Petitioner Feroz Khan for grant of regular Bail in FIR No.712/2016, under Section 302/201/34 IPC, P.S.Shakarpur. 3.

It is submitted in the Application that the Petitioner/Applicant is in judicial custody since 29.01.2020. He has been implicated falsely in that case. Most of public witnesses already stand recorded. The case is based on circumstantial evidence. The co-accused Suman @ Pooja has already been granted bail. Since there is no prima facie case against the Applicant and there is no apprehension of his fleeing for justice, hence the bail is sought.

wife to death. The Bail Application is opposed. 5.

Submissions heard and record perused.

The case of the prosecution about murder of the deceased by her husband/Applicant along with the co-accused Suman @ Pooja is no doubt an heinous offence but the accused is in judicial custody since 29.01.2020. Material public witnesses have already been recorded. The co-accused has been admitted to bail. 7.

Considering the totality of circumstances, The Applicant shall furnish a bail bond in the sum of Rs.25,000/- and one surety of the like amount, subject to the satisfaction of the learned Trial Court; a) The Applicant shall appear before the Court as and when the matter is taken up for hearing;

b) The Applicant shall provide mobile number to the IO concerned which shall be kept in working condition; c) The Applicant shall not indulge in any criminal activity and shall not try to influence the witnesses or tamper with the evidence;

d) In case of change of the residential address, the same shall be intimated to this Court and in the Police Station, by the Applicant.
