The Regular Bail Application under Section 439 Cr.P.C has been filed on behalf of the petitioner wherein it is submitted that the accused is a 19 year old boy and is in judicial custody since 27.07.2023. 2.
The Petitioner had applied for regular bail before the learned Sessions Judge which has been rejected vide Order dated 07.12.2023. It is further submitted that the Charge Sheet has already been filed in the present case and he may be granted Bail on account of the various discrepancies in the Statements of Witnesses and their conduct.

The petitioner is a young boy of 19 years and his further extension in the company of hardened criminal would affect his future and his mentality. Nothing was recovered from his possession or at his instance and whatever recovery is made has been planted. He was not present at the place of incident and there is no question of his involvement. He is a sole earner in his family and is implicated falsely in this case.

The Status Report has been submitted on behalf of the State. 6.
It is further submitted that the accused has shown the knife while committing the robbery and he has been identified by the complainant in the TIP Proceedings. The recovery of the stolen property has also been made pursuant to his disclosure statement and he has also led to the recovery of knife which is the weapon of offence. Charges have already been framed and the Statement of the complainant is yet to be recorded. The Bail Application is therefore opposed.

There are serious allegations of robbery on knife point against the accused applicant and the testimony of the complainant is yet to be recorded. There is an apprehension of threat/intimidation of the complainant. 9.
No Bail is made out at this stage and the application is hereby dismissed.
