This is a petition filed seeking a grant of interim bail for a period of 8 weeks in FIR No. 267/2022 dated 14.04.2022 registered at PS Shahbad Dairy under Sections 20 and 25 of NDPS Act. 2.
In the present case, as per the medical status report of the petitioner dated 03.03.2025, it is stated as under:- "It is submitted that, as per available records, the aforementioned inmate/patient is a 60 year old senior citizen and is post-operative case (left-hip hemiarthoplasty) (bipolar prosthesis placed inside) of right neck of femur fracture who is suffering from right hip pain and also a follow up case of carious teeth, impaired hearing both ear post ear trauma with ear buds and He is taking treatment from jail duty doctors, jail visiting specialist doctors, Dr.

specialist doctor on multiple occasions as his symptom of post-operative pain was not subsiding. He has been hospitalized for a prolonged period in the post-operative ward as the postoperative wound got infected for which debridement was done again 14.08.2024 at Dr. BSA Hospital. He was prescribed medication and has been advised to use a walker for mobility. He has also been advised to use a soft mattress by the treating surgeon at Dr. BSA Hospital. He is on continuous medication for his pain. He has also been advised to avoid squatting/sitting cross legs. Moreover, he is complaining of not being able to conduct his routine activities without third-party support.
He was sent to MAIDS Hospital on 05.01.2025 for root canal treatment; wherein, he was seen by the treating dentist and his next appointment date was given for 03.02.2025. He has been scheduled for the same. At present, the inmate/patient has been advised to and is using a walker for mobility. His surgical site has healed. However, he is still suffering pain in hip (moderate to severe at times) which is not subsiding despite being on symptomatic medication. His current medical condition is interfering with his routine activities."

On perusal, I am of the view that the medical condition of the petitioner is not good and he requires better treatment for the pain in his hip as the symptomatic treatment is not achieving desired results. For the said reasons, the petition is allowed and the petitioner is granted interim bail for a period of 4 weeks on ground of his medical treatment subject to the following terms and conditions: a.
The petitioner shall furnish a personal bond with one surety in the sum of Rs. 10,000/- each to the satisfaction of the concerned trial court;
b.
The petitioner shall not leave the country without the permission of the concerned court and if the petitioner has a passport, he shall surrender the same to the concerned trial court;
c.
The petitioner shall furnish to the IO concerned the cell phone number on which the petitioner may be contacted at any time and shall ensure that the number is kept active and switched on at all times;
d.
The petitioner will furnish his permanent address to the concerned IO and in case he changes his address, he will inform the IO concerned;
e.
The petitioner shall not indulge in any act or omission that is unlawful, illegal or that would prejudice the proceedings in pending cases, if any;
f.
The petitioner shall appear in Court on every date of hearing unless exempted;
g.
The petitioner shall not communicate with, or come into contact with the complainant or any of the prosecution witnesses, or tamper with the evidence of the case. 5.
