% 27.02.2026 CM APPL. 13692/2026 (restoration of main case) 1.
The application seeks revival of the W.P.(C) 2563/2026 which was disposed of by the Court vide order dated 24.02.2026, granting liberty to the petitioner to revive the petition in case the appeal is not heard or the grievance is not mitigated.
2.
The facts would indicate that the petitioner challenged the order dated 22.01.2026 passed by the Insolvency and Bankruptcy Board of India in W.P.(C) 1901/2026. The said writ petition was disposed of on 10.02.2026, directing the petitioner to avail an alternative remedy under Rule 17(9) before the Companies (Registered Valuers and Valuation) Rules, 2017. petitioner, thereafter, raised the grievance in a fresh writ petition i.e. W.P.(C) 2563/2026 that the appeal was preferred on 14/16.02.2026 and the same was not being taken up for consideration. 3.
On the assurance of the respondent, who stated that the appeal would be taken up on 26.02.2026, even the said writ petition was disposed of with the hope that the appellante authority would take up the petitioner's application and at least consider his interim prayer. At the request of the petitioner, liberty was granted to revive the writ petition if, in case, necessity arises.
4.
By way of the instant application, the petitioner submits that even on 26.02.2026, the hearing was adjourned for 05.03.2026. 5.
Under these circumstances, the Court, without prejudice, deems it appropriate to direct the impugned order to be kept in abeyance for its further implementiation, till the application for interim relief is decided by the appellate authority.
6.
Application stands disposed of.
