This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers:
"(a) Issue a writ, order or direction in the nature of declaration declaring that no action of demolition can be taken by the respondent in respect of construction raised upon land bearing Khasra Nos. 19/21/2 (2-4), 20/2 (2-19) and 20/9 (5-1) at Village Kamalpur Majra, Burari, Delhi, part of unauthorized colony namely "A2 Block, West Sant Nagar, Burari, Delhi - 110084" unless the issue of pending The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
regularization of the colony is decided by the concerned authorities; and/or (b) Issue a writ, order or direction in the nature of prohibition prohibiting action of demolition by the respondent in respect of construction raised upon land bearing Khasra Nos. 19//21/2 (2-4), 20/2 (2-19) and 20/9 (51) at Village Kamalpur Majra, Burari, Delhi, part of unauthorized colony namely "A2 Block, West Sant Nagar, Burari, Delhi - 110084" being protected under Delhi National Capital Territory Laws (Special Provisions) Act, 2011; and/or..."

Mr. Yadav, learned senior counsel for the petitioner, states that the petitioners are the owners of Khasra No. 19/21/2 (2-4), 20/2 (2-19) and 20/9 (5-1) at Village Kamalpur Majra, Burari, Delhi, part of unauthorized colony namely A2 Block, West Sant Nagar, Burari, Delhi - 110084. He also states that the colony is pending for regularization. 3.
The ownership is based on an order dated 06.04.2010 passed by the Revenue Assistant, S.D.M. (civil lines) in favour of one Ramphal and Ram Kishore under Section 85 of the Delhi Land Reforms Act, 1954. 4.
The petitioners have purchased the said property by duly registered sale deed from Shri Ramphal and Shri Ram Kishore. Hence, the petitioner Nos. 1, 2 and 3 are the owners of the said Khasras. 5.
Thereafter, one Shri. Subhash filed a petition seeking demolition of alleged unauthorized construction on the aforeaid Khasras. Since the same was not done, a contempt petition being Cont. Case (C) No. 1234/2024 was filed.

In the said contempt petition, the Court vide Order dated 09.08.2024 directed the petitioner therein to take steps to implead the STF as well as the wrong doers who are alleged to have carried out such unauthorized construction.

Learned counsel for the petitioner, states that this was a direction to implead them as a party and hear them before carrying out any demolition action. Since the same has not been done and demolition has already been directed to be carried out in the order of 09.02.2026, the present petition has been filed.

From the aforesaid narrated facts, it seems that the only grievance of the petitioner is that the petitioner has not been heard by the STF and there is demolition action threatening their properties. 10.
For the said reasons, issue notice.

Ms. Tripathy, learned standing counsel accepts notice on behalf of the respondent and states that the petitioner should agitate their grievances before STF, as directed in the order dated 09.02.2026, it is the STF who has been directed to hear the concerned parties regarding their grievances including their contentions concerning title documents. 12.
In this view of the matter, it is directed that the STF shall grant a personal hearing to the counsels for the petitioners given in the petition and will treat the present writ petition as a representation, and after hearing the petitioners will pass a detailed speaking order. Demolition in Khasra No. 19//21/2 (2-4), 20/2 (2-19) and 20/9 (5-1) at Village Kamalpur Majra, Burari, Delhi, part of unauthorized colony namely A2 Block, West Sant Nagar, Burari, Delhi - 110084 shall be carried out depending on the outcome of the hearing of the STF. 14.
The order be communicated to STF and the STF will fix a date at its convenience expeditiously.
