% 11.01.2019 Caveat No.18/2019 Despite the caveat being listed, none appears for the caveator. The caveat stands discharged.

W.P.(C) 201/2019 & C.M. APPL. 973-974/2019 The petitioner has preferred the present writ petition to assail the order dated 01.12.2017 passed by the Central Administrative Tribunal Principal Bench, New Delhi ('Tribunal') in M.A. No.3611/2017 in OA No.3406/2017. By the said interim order, the Tribunal directed that the vacancies for the post of LDCs Post Code 68/12 shall not be carried forward.

According to the respondents/applicants, the said direction was breached and, consequently, the Contempt proceedings were initiated vide CP No.386/2018.

Ms. Ahlawat submits that the petitioners have already filed their replies to the Original Application, as well as Contempt proceedings,

wherein the stand taken by the petitioners is that the vacancies of LDCs were all filled up and were not carried forward, and the vacancies which were carried forward were those having horizontally reserved for categories such as ex-service man, physically handicapped, sports persons etc. Ms.

Ahlawat submits that the petitioners have requested the Tribunal to hear the Original Application itself along with the Contempt proceedings. However, that is not being done.

We are sure that the Tribunal shall consider the response of the petitioners-both in the Original Application and in the Contempt Petition, and it shall also consider the feasibility of hearing both the Contempt Petition as well as the Original Application simultaneously, considering that the same stand had been taken by the petitioners in both the proceedings. With these observations, we dispose of the present petition. All the pending applications also stand disposed of.
