The present appeal arises out of the conviction rendered under Section 138 of the Negotiable Instruments Act by the learned Court of Sessions. 2.
On the previous date of hearing, service upon the appellant was directed to be effected through the concerned SHO. Today, learned APP for the State has handed over a copy of the status report, which is taken on record. As per the said report, upon inquiry made from the appellant's nephew, namely Deepak Sonkar, son of late Subhash Sonkar, resident of H. No. 10405, Manakpura, Near Filmistan Cinema, Karol Bagh, Delhi, it was revealed that the appellant had expired in the year 2018. A copy of the death certificate has been filed along with the status report, which is taken on record. The death certificate records that the appellant expired on 21.07.2018.

In view of the aforesaid facts, the proceedings in the present appeal stand abated, and the appeal, along with all pending applications, is disposed The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The amount of Rs.60,000/- along with accrued interest thereon, deposited in terms of order dated 20.05.2004, shall be released to respondent no. 1 as per rules, after due verification.
