This appeal was filed assailing the judgment of conviction dated 30th October, 2023 and order on sentence dated 01st November, 2023 in FIR no. 771/2000 PS Dabri under Sections 307 IPC.

The appellant was sentenced to RI for 2 1⁄2 years and fine of Rs. 1000. It is noted in order dated 02nd December, 2003, that the appellant had already undergone about 21 months of imprisonment and fine has been paid. 3.

The sentence was suspended by order dated 02nd December, 2023, of this court.

Appellant appears and states that he does not does not wish to pursue the appeal.

In these circumstances, considering overall facts and circumstances, the appellant is sentenced is reduced to the period already undergone. 6.
