O R D E R

% 26.02.2026 By way of the present petition filed under Article 226 of the Constitution of India read with section 528 of the Bharatiya Nagarik Suraksha Sanhita 2023, the petitioner seeks release on parole, while challenging conditions Nos. 7 and 9 of order dated 27.01.2026 by which the jail authorities have declined to release the petitioner only because co-convict Manoj is already on parole and is yet to surrender. The petitioner has been granted parole by the jail authorities vidé order dated 27.01.2026 subject however to the aforesaid condition viz., that ordinarily co-convicts are not be released on parole simultaneously.

Pursuant to notice issued on the last date, Mr. Sanjeev Bhandari, learned ASC for the State has handed-up a copy of Status Report dated 26.02.2026 alongwith a copy of the petitioner's nominal roll. The status report is taken on record.

In the status report, the State has reiterated their position viz., that as per Rule 1212 of the Delhi Prison Rules 2018, ordinarily the petitioner cannot be released on parole simultaneously with coconvict Manoj;

and that his request dated 04.02.2026, for simultaneous release is still pending with the Home Department. 4.

The nominal roll shows that the petitioner has suffered actual custody of more than 15 years and has earned remission of more than 01 year; that his jail conduct has been 'satisfactory'; and that he has been released on interim bail, emergency parole, parole as well as furlough on multiple occasions.

The status report recites that co-convict Manoj is supposed to surrender to custody today, i.e., 26.02.2026. 6.

In view of the above, upon a balance of all considerations, this court considers it just and fair that the petitioner be permitted to avail the parole granted by the jail authorities vidé order dated 27.01.2026 upon the surrender of co-convict Manoj, which is to happen today. The petitioner is accordingly permitted to fulfil the other conditions of parole as stipulated in order dated 27.01.2026, whereupon, he is directed to be released on parole.

A copy of this order be sent to the concerned Jail Superintendent forthwith.
