The petitioner and respondent no. 2 are present before this Court and have been identified by their counsels and concerned Investigating Officer (IO) from Police Station North Rohini, Delhi. 6.
Briefly stated, facts of the present case are that in the year 1992, respondent no. 2 had took a shop bearing no. 8 situated at Krishna Market, Naharpur, Rohini Sector-7, Delhi on rent, from the petitioner. It is stated that on 10.01.2012, some dispute had arisen between the parties and the possession of the shop was taken by the petitioner and thereafter, on the complaint of respondent no.2, the present FIR was registered against the petitioner under the relevant sections. It is stated that both the parties have amicably settled the present matter vide Memorandum of Understanding dated 10.12.2025, entered between them.
7.
On a query made by this Court, respondent no.2 who has been identified by the concerned IO, has categorically stated that he has entered into compromise out of his own free will and without any pressure, coercion or threat. It is also stated by respondent no. 2 that the entire dispute has been amicably settled between the parties and that he has received remaining amount of Rs. 1,50,000/- by way of Demand Draft bearing no. 104531 dated 07.02.2026 drawn on Bank of Baroda, Sector-7, Rohini Branch, Delhi, as per settlement. Respondent no. 2 further states that he has no objection, if the present FIR is quashed.
8.
In view of the above fact that the parties have amicably resolved their differences out of their own free will, without any coercion and no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in interest of justice The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question. 9.
Accordingly, FIR bearing No. 11/2012, registered at Police Station North Rohini, Delhi for the commission of offence punishable under Section 448/380/451/457/34 of IPC and all consequential proceedings emanating therefrom are quashed.
10.
However, the matter has been pending for the last 13 years before various Courts. It is clear that the parties have taken their own time to inform the court that the FIR be quashed. In these circumstances, both, the time of the court and the investigating agency has been consumed. The petitioner has expressed his willingness to compensate for the time so consumed by contributing for a socially relevant cause. 11.
In the circumstances, petitioner is directed to deposit Rs.20,000/- with the Delhi High Court Bar Clerk's Association Fund, within a period of two weeks from date and compliance of the same be filed before the Registry of this Court.
