O R D E R

1.

Settlement Agreement dated 28th November, 2024 has been received from the Delhi High Court Mediation and Conciliation Centre. 2.

The present suit has been filed by the plaintiff seeking a permanent injunction against the defendant alleging infringement of plaintiff's registered trademark and its copyright, passing off, breach of confidentiality, as well as other ancillary reliefs.

at Hyderabad bearing No. O.S. 14/2024, alleging defamation and tarnishment of the defendant's reputation by the plaintiff, which is next listed for hearing on 4th December, 2024.

The present suit, i.e., CS(COMM) 145/2024, was referred to the Delhi th High Court Mediation and Conciliation Centre, vide order dated 16 February, 2024, wherein, the parties have successfully resolved their disputes and have negotiated the Settlement Agreement dated 28th November, 2024.

Learned counsel appearing for the parties confirm the terms of the settlement and pray that the suit be decreed in terms of the settlement. 6.

They further point out to para 10 of the Settlement Agreement to submit that certain terms between the parties are confidential, which be kept confidential.

This Court has perused the terms of the settlement and finds the same to be lawful.

The parties are held bound by the terms of the settlement. 9.

Accordingly, the present suit is decreed in favour of the plaintiff and against the defendant in terms of the Settlement Agreement dated 28th November, 2024, between the parties, terms of which, except the confidential terms as stated in para 10, shall form part of the decree. 10.

Considering the fact that para 10 of the Settlement Agreement dated th November, 2024 is confidential between the parties, the Registry of this Court is directed that none else, except the parties before this Court shall be given certified copy of the Settlement Agreement dated 28th November, 2024.

before this Court, are directed to be returned to the respective parties, upon the respective parties approaching the Registry, in this regard. 12.
