On the last date of hearing, noting the absence of the parties, notice was directed to be issued to the parties as well as their counsels. The notice on the respondent could not be served. The appellant who is represented through Mr. B.S. Chauhan, who is present in Court, submits that the appellant has paid the fine amount and the receipt of the same is placed on record.

The present appeal arises out of trial held for offence punishable under Section 138 NI Act. The appellant was convicted by the Court of Sessions and sentenced only to pay fine of Rs. 60,000/-, the cheque amount being Rs.48,568/-.

Mr. B.S. Chauhan has handed over his gate pass and states that having deposited the fine, he accepts the conviction and does not want to contest the present appeal on merits. He submits that even the fine amount is released to the complaint.
