1. Exemption allowed, subject to all just exceptions. W.P.(C) 257/2019

2. The Petitioner is seeking a direction to Respondents to "immediately appoint the Petitioner with the Respondent Department or any other government department".

3. From the narration of the petition, it appears that the Petitioner joined the Indo Tibetan Border Police Force (ITBP) as a Constable by clearing all W.P.(C) 257/2019

stages way back on 17th December, 2007. On grounds of medical unfitness of "alleged bipolar disorder", he was boarded out by an order of the 39th Battalion, ITBP on 21st June, 2010 itself.

4. From the narration of the petition, it appears that it is only five years thereafter, on 31st August, 2015, that the Petitioner protested against his boarding out of service. He stated to have sent another letter on 6th February, 2017 and finally a legal notice on 15th February, 2018.

5. The Court is not satisfied to the explanation offered by the Petitioner for the inordinate delay in his pursuing his remedies, after having been boarded out way back on 21st June, 2010.

6. The petition is dismissed on the ground of laches. S. MURALIDHAR, J.
