The present writ petition has been filed under Articles 226 and 227 of the Constitution of India by the petitioner seeking following reliefs:
"(a) Issue a Writ of Mandamus directing the Respondent Bank namely the Punjab National Bank to issue Sale Certificates in respect of Shop No. 3, 4, and 9 (Ground Floor without Roof Rights), Property Old No.312, Nagar Nigam, New No. 343, Railway Road, Bajaria, Ghaziabad, measuring 19.926, 20.438 and 40.876 sq. mtr. respectively in terms of the provisions of Rule 9 ( 6) for Immoveable Property under the provision of Security Interest (Enforcement) Rules, 2002; and/or in The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. the alternative;
(b) to direct the Ld. Debts Recovery Tribunal1, New Delhi to decide the SA/140/2025 expeditiously; and/or"

Heard learned counsel for the petitioner.

The learned counsel for the petitioner submits that the Core grievance of the petitioner would substantially be met in case, the petitioner is permitted to file an urgency/early hearing application before the concerned Debt Recovery Tribunal (hereinafter referred to as, „DRT‟), with direction to concerned DRT to decide the securitisation application expeditiously and in accordance with law, without any unnecessary adjournments.

Looking into the facts and circumstances of the present case, we find that such a discretion can be exercised and accordingly, the petitioner is permitted to file an appropriate application with regard to their urgency before the concerned DRT.

As soon as the application is filed, we expect that the concerned DRT shall consider the same and decide the securitisation application expeditiously, without granting unnecessary adjournments, in accordance with law.

With the aforesaid observation, the petition along with pending applications, if any, stands disposed of.
