This petition has been filed seeking the following prayer: - Quash the FIR No. 0002/2020 dated 03.01.2020, under section 406, 420 & 34 of Indian Penal Code registered at Prashant Vihar Police Station, Chargesheet dated 07.02.2024 and subsequent trial court proceedings arising therefrom pending as Cr. Case 1376/2024 titled 'State vs. Smt. Suchita Goyal' pending before LD. MM. North - District, Rohini Court;

Learned senior counsel for the Petitioner states that the subject FIR was filed on a complaint filed by Respondent nos. 2 and 3 with respect to Shop No. G-23, Ground Floor, Plot no. SU, Local Shopping Centre, Rohini. 3.

He states that the disputes have been amicably resolved between the Petitioner and the Complainants/Respondent nos. 2 and 3 and in this background the present quashing petition has been filed. 4.

investigation three more complaints were received against the Petitioners herein.

He states that for the Plot no. SU, Local Shopping Centre, Rohini; complaints were received from Ms. Sujata Mendirata, Mrs. Preeti Nagpal and Mr. Sanjay Nagpal with respect to Shop No. G-22, G-24 and G-25 as well.

He states that as recorded in the order dated 07.07.2022 in CT. Cases no. 5932/2019 passed by MM-04 (North), Rohini Courts Delhi no separate FIR was registered qua the complaints of Ms. Sujata Mendirata, Mrs. Preeti Nagpal and Mr. Sanjay Nagpal as their allegations qua Petitioners were identical to that of Respondent nos. 2 and 3 in FIR No. 0002/2020 therefore the concerns of the said individuals were clubbed along with FIR No. 0002/2020 and the said individuals have also been enlisted as witnesses in the aforesaid FIR.

He states that the charge-sheet has since been filed and therefore unless the Petitioner resolves the matter with all the complainants, there cannot be partial settlement with Respondent nos. 2 and 3. 8.

In response, learned senior counsel for the Petitioner states that he seeks liberty to withdraw this petition at this stage to examine the submissions of the learned APP and file a fresh petition in accordance with law.

The petition is disposed of with a liberty reserved. 10.
