Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 („BNSS‟) has been filed on behalf of the Petitioners for quashing of FIR No.0245/2017 under Sections 323/354A/506/34 IPC, registered at PS: Nand Nagri, Delhi and all consequential proceedings emanating therefrom, in terms of Mediation Settlement Deed dated 06.11.2024. 2.

Brief facts of the case, as per FIR are that on 17.04.2017, when the Complainant / Respondent No.2 was standing outside her house at about 09:00 AM, Petitioners, who are neighbours, were off-loading their Tractor Trolley. She asked the Petitioners to off-load the same outside the gali, as her pipe line got bend. On which, Petitioners pushed her, abused her and told her to go away and do her work and also threatened her kill her. It is further submitted that on 17.04.2017, on Complaint of Respondent No. 2, FIR No.0245/2017 under Sections 323/354A/506/34 IPC was registered at PS: Nand Nagri, Delhi.

It is submitted that present FIR was a consequence of the disputes between Petitioners and Respondent No.2, who are neighbours. It is stated that the Petitioners and Respondent No.2 have amicably settled all the disputes and differences between them vide Mediation Settlement Deed dated 06.11.2024.

The parties are present in the Court and have been identified by their respective counsel. The parties submit that they have arrived at the settlement without any force, coercion and undue influence and pressure and they have signed the Settlement Deed dated 06.11.2024 with their wish and will. 8.

Learned Counsel for Petitioners submits that the parties have no grievance against each other. Since Respondent No.2 has already made a statement before the Court that she does not want to pursue the proceedings in FIR, the present Petition be allowed and FIR No.0245/2017 be quashed. 9.

In view of Mediation Settlement Deed dated 06.11.2024, present Petition has been filed.

Respondent No.2 is present and submits that she has no grievance against the Petitioners and also no objection to the quashing of FIR. 11.

In view of the fact that the FIR in question was premised upon a neighbours dispute between the Petitioners and Respondent No.2, which has been amicably resolved in terms of Mediation Settlement Deed dated 06.11.2024. Considering the fact that parties have been settled the dispute and Respondent No.2 has also given no objection to the quashing of FIR, no fruitful purpose would be served in continuing with the proceedings arising The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
