O R D E R

The paragraph No.4 of the order dated 14.09.2023 [hereinafter referred to as „Impugned Order‟] passed by the learned Central Administrative Tribunal, Principal Bench, New Delhi („Tribunal‟) reads as under:

"4. In view of the above, the present O.A. is disposed of with a direction(s) to the competent authority amongst the respondents to consider the case of the applicant(s) for grant of increment in light of the decision passed by the Hon'ble Apex Court in the matter of KPTCL (supra), thereby passing appropriate orders for re-fixing of pay / pension and grant of arrears thereto in accordance with law. The said exercise be completed, within a period of three months from the date of receipt of a certified copy of this Order and a copy of the speaking order so passed be given to the applicant(s). It is made clear that we have not entered into the merits of the case." 2.

The Petitioner has been directed by the Tribunal only to pass appropriate orders for grant of increments in light of the decision passed by the Supreme Court in Director (Admn. and HR) KPTCL v. Learned counsel for the Petitioner has failed to explain the basis for filing the present writ petition, particularly when the Petitioner was granted liberty to pass appropriate orders. Moreover, the last line of paragraph No.4 of the impugned order clearly records that the Tribunal had not entered into the merits of the case. 4.

Keeping view the aforesaid facts, the present Petition, along with pending application, is dismissed.
