The accused/applicant seeks regular bail in case FIR No. 762/2020 of Police Station Adarsh Nagar for offence under Section 302/201/120B IPC. 3.

Broadly speaking, this is a case based on circumstantial evidence with the allegations that the accused/applicant along with co-accused Zuber killed the deceased and dumped the body in Gujarat. According to prosecution evidence, the deceased was last seen entering the house of the accused/applicant at 01:33 am on 13.11.2020 but was not seen coming out. The entry was captured in CCTV. accused/applicant after which at 08:32 am, the accused/applicant and her mother boarded an Ola cab along with a big box, allegedly containing dead body. Thereafter, according to the CCTV of Nizamuddin Railway Station, Zuber was seen loading that big box in the Goa Express. The body was recovered from Gujarat.

Against this backdrop, the Ola driver Bunty is star witness of prosecution and his chief examination is yet to be concluded on 15.04.2026. 5.

On instructions, learned counsel for accused/applicant seeks permission to withdraw this bail application with liberty to file afresh before the trial court subsequent to testimony of Bunty. 6.

As requested, the bail application and the accompanying application are dismissed as withdrawn with liberty as sought. It is directed that prosecution shall ensure completion of testimony of Bunty on 15.04.2026 and if for some reason, Bunty does not appear, the learned trial court shall hear the bail application of the accused/applicant without getting influenced with any order of this Court.
