Petitions under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'B.N.S.S.'), have been filed on behalf of the Petitioners for quashing of FIR No.565/2020 and FIR No. 566/2020 under Section 323/354/354A/34 the Indian Penal Code, 1860 (hereinafter referred to as 'IPC') registered at Police Station New Usmanpur, Delhi and all the consequential proceedings emanating therefrom, in terms of the Settlement Deed dated 04.01.2025. 4.

Issue Notice.

On advance Notice, learned APP has appeared and accepted the Noteice on behalf of the State.

Brief facts of the case are that the parties are neighbours, who were living in the same building at E-35, 3rd Floor, Gali No. 6, Brahampuri, Delhi since long time and a fight had initiated between them on account of some misunderstanding, which resulting in the registration of the said FIR. 7.

On the Complaint of the Respondent No.2/Complainant, FIR No.565/2020 and FIR No. 566/2020 under Section 323/354/354A/34 of IPC, got registered at Police Station New Usmanpur. 8.

It is stated that the Petitioners and the Respondent No. 2 have amicably settled all the disputes and differences between them and arrived at Settlement Deed dated 04.01.2025. future of both families as well as for peaceful atmosphere. It is also settled that both the parties shall not file any case in relation to the above said disputes against each other or their family members in future. 9.

Today, the Respondent No. 2 is present in the Court, states that she has no objection if the said FIRs are quashed. 10.

Both the parties have entered into the Settlement voluntarily and without any fear and coercion and undertake to remain bound by the terms of the said Settlement.

Considering the nature of the allegations and that they have settled the matter, the FIR No.565/2020 and FIR No. 566/2020 under Section 323/354/354A/34 of IPC, registered at Police Station New Usmanpur, Delhi and all the consequential proceedings emanating therefrom are quashed. 12.

The Petition is disposed of accordingly.

The Registry is directed to redact the name of the Complainant/Prosecutrix in all the proceedings of the case bearing CRL.M.C. 1071/2025.
