% 14.02.2025 By way of the present petition filed under sections 438/442 of the Bharatiya Nagarik Suraksha Sanhita 2023 read with section 19(4) of Family Court Act, the petitioner impugns order dated 30.08.2024 whereby the learned Family Court has granted interim maintenance of Rs. 8,5000/- per month to the respondent under section 125 of the Code of Criminal Procedure, 1973 ('Cr.P.C.'). 2.

Ms. Priya Kakran, learned counsel appearing on behalf of the petitioner submits, that a separate petition under section 125 Cr.P.C. has been filed by the respondent before the learned Family Court in Meerut, Uttar Pradesh. Ms. Kakran also argues that the maintenance awarded by way of the impugned order is excessive in nature. 3.

It is observed that the petition seeking interim maintenance under section 125 Cr.P.C. was filed before the learned Family Court in CRL.REV.P.(MAT.) 74/2025 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. Delhi on 17.05.2022; whereas the petition under section 125 Cr.P.C. alleged to have been filed before the learned Family Court in Meerut is dated 23.02.2023.

After making brief submissions in the matter, learned counsel seeks leave to withdraw the present petition, with liberty to raise all rights and contentions including those noted above before the learned Family Court in the course of the proceedings, which are stated to be pending at the stage of recording evidence.

The petition is disposed-of as withdrawn, with liberty as prayed-for; without making any observations on the merits of the matter. 6.

Pending applications, if any, also stand disposed-of.
