% 11.03.2019 Initially, FIR was registered under Sections 323/341/34 IPC.

However, subsequently, offences under Sections 308/304/354A/354B/376 were also added pursuant to the statement under Section 164 Cr.P.C. of the complainant.

Learned counsel for the petitioner submits that there are no allegations of rape against the petitioners in the FIR as well as in the statement under Section 164 Cr.P.C. of the complainant, which was recorded after about one and a half months of registration of FIR.

It is submitted that petitioners are neighbours of co-accused Anish Kumar. On 07.07.2018 a quarrel took place between the family members of co-accused and complainant which led to registration of present FIR.

Anish, have unnecessarily been roped in by the complainant. It is further submitted that co-accused Anish Kumar and Pankaj Kumar have already been admitted to bail by this Court, therefore, it is prayed that benefit of anticipatory bail may be extended to the petitioners. Keeping in mind the fact and circumstances of this case, it is ordered that in case of arrest petitioners be released on bail, subject to their furnishing a personal bond in the sum of `20,000/- each with one surety each in the like amount to the Arresting Officer/Investigating Officer/SHO of the concerned police station.

Bail application is disposed of in the above terms. Dasti.
