During the course of hearing, respective counsel for the parties submit that Appeal No. 59/2024 filed by the petitioner before the ATMCD stands disposed of.

As such, no further order/s are required to be passed in the present petition inasmuch as the grievance raised in the present petition is as regards the interim arrangement that would subsist during the pendency of the aforesaid appeal.

In the circumstances, the petitioner seeks to withdraw the present petition with liberty to avail appropriate remedies against the final order passed by the ATMCD, by filing an appeal before the learned Principal District and Sessions Judge, East District, Karkardooma Courts. submitted that the same would be filed latest within a within a period of 2 weeks from today, alongwith an application seeking interim relief. 4.
Accordingly, the present petition is dismissed as withdrawn with liberty as prayed for. In the interregnum, learned counsel for the MCD submits, on instructions, that no coercive/ precipitative steps shall be taken for a period of 2 weeks from today.
