% 15.01.2018 Crl. M.A. 738/2018(exemption) Allowed, subject to all just exceptions.
CRL.M.C. 178/2018 1.
The petitioner seeks quashing of FIR No.180/2009 under Section 498-A IPC emanating out of the matrimonial discord. 2.
Learned counsel for the petitioner submits that the parties have settled their disputes before the Mediation Centre, Rohini, and consequent to the Settlement, even a divorce by mutual consent has Crl.M.C.178/2018
been obtained and the final decree of divorce having been passed on 01.08.2017.
3.
Respondent No.2 is present in Court and is identified by her counsel as well as by the Investigating Officer. She confirms that the dispute is settled and a sum of Rs.50,000/- is due and payable to respondent No.2. The said amount has been handed over by way of a demand draft bearing No.749243 dated 09.01.2018 issued by the Punjab National Bank, in the name of respondent No.2. She submits that she does not wish to press the complaint any further. 4.
In view of the above and keeping in view of the fact that the FIR emanates from matrimonial discord and the parties have resolved their disputes and respondent No. 2 does not wish to press his complaint, there would be no fruitful purpose in continuing with the prosecution.
It would further be expedient and in the interest of justice to quash the FIR and the consequent proceedings. 5.
Consequently FIR No.180/2009 under Section 498-A IPC, Police Station Nangloi and the consequent proceedings emanating therefrom are hereby quashed.
