% 19.02.2018 It is submitted that petitioners and respondent nos. 2 and 3 are neighbours. A quarrel took place between them on some trivial issues, which led to registration of the FIR No. 40/2009 under Sections 308/323/34 IPC at police station Neb Sarai, on the complaint of respondent no. 2. With the interventions of their common friends and other family members, petitioners and private respondents have arrived at an amicable settlement vide a Compromise Deed dated 5th January, 2018; therefore, aforesaid FIR and the consequent proceedings emanating therefrom may be quashed. Respondent nos. 2 and 3 are present in Court and have been identified by SI Shri Bhagwan of Police Station Neb Sarai.

Respondent nos. 2 and 3 submit that

they have settled the matter with the petitioners of their own free will and without any undue force, pressure or coercion and they has no objection in case the FIR is quashed.

Keeping in view the settlement arrived at between the petitioners and respondent nos.2 and 3 voluntarily, in my view no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, FIR No.

40/2009 under Sections 308/323/34 IPC registered at police station Neb Sarai and the consequent proceedings emanating therefrom are quashed. Petition is disposed of in the above terms. Dasti. A.K. PATHAK, J.
