This is an application filed on behalf of the Applicant under Section 439 Cr.P.C. seeking regular bail in FIR No.601/2024 dated 17.06.2014 registered under Sections 302 IPC at PS-Sarai Rohilla. Subsequently, Section 34 IPC and Section 27 of Arms Act, 1959 were added in the charge sheet.

After some arguments, counsel for Petitioner seeks to withdraw the application to approach Court after remaining four remaining witnesses have been examined but seeks a direction to the Trial Court to expedite the recording of evidence of 4 remaining witnesses. 3.
Order dated 11.07.2023 which is annexed as Annexure-H to the petition indicates that this Court had directed Trial Court to expeditiously complete the trial preferably within six months. However, this is an admitted position that the trial is still at the stage of recording of evidence of Prosecution witnesses.

Considering the fact that Applicant is under incarceration for a long time, Trial Court is requested to ensure that the remaining four prosecution witnesses are examined within a period of two months from today. Prosecution shall ensure that necessary witnesses are present on the dates fixed by Trial Court and Trial Court will not give unnecessary adjournments for witnesses to appear for their examination. 5.
