The petitioner has filed the present petition, inter alia, praying that the respondents be directed to survey the petitioner as well. It is the petitioner's case that he has been carrying on the vending activities since the year 2007. The petitioner's name also finds mentioned in the list of 628 vendors that were found eligible for the allotment of spaces within the jurisdiction of New Delhi Municipal Council (NDMC) in the year 2012. However, that exercise was subsequently abandoned.

Palika Bazar on account of the said area being declared as a no vending no hawking zone. The petitioner states that notwithstanding his removal, the petitioner continued to vend in the given area in order to earn his livelihood. The petitioner apprehends that since he has been removed from a no vending no hawking zone, he would not be included in the survey of the street vendors, which is now being conducted by the NDMC. 3.

Clearly, there is ample material on record to establish that the petitioner is a bona fide street vendor, and therefore, the NDMC is required to include him in the survey of street vendors that is being conducted. 4.

In view of the above, we dispose of the present petition by directing the respondents to permit the petitioner to participate in the survey. The petitioner would be entitled to furnish all relevant documents and material to establish that he has been carrying on his vending activities. Subject to verification of the details, the same would be recorded in the data collected by the NDMC.

The petition is disposed of in the aforesaid terms. Pending applications shall also stand disposed of.
