Learned counsel for the petitioner prays for an interim bail on the ground that the petitioner has suffered a fracture in the right leg and as per the medical report dated 05.02.2024 from the Jail Medical Officer In-charge, Central Jail No.12, Mandoli, which is handed over in the Court, he has been advised to undergo surgery. The same is taken on record. 2.

He also invites the attention of the Court to the photograph at page 46 of the paper book to show that his right leg has been plastered and he has been rendered immobile.

Attention of the Court is also drawn to the order of the Metropolitan Magistrate dated 01.02.2024 which shows that the petitioner was present in the Court on a wheel chair and he had been discharged from the hospital on the day he was arrested and produced in the court. In view of the above, the petitioner has made out a case for grant of interim bail for a period of two weeks from the date of his release subject to his furnishing a Personal Bond in the sum of Rs.20,000/- and a Surety Bond of the like amount, subject to the satisfaction of the learned Trial Court/CMM/Duty Magistrate, further subject to the following conditions:- (a) Petitioner/applicant will not leave the city without prior permission of the Court.

(b) Petitioner/applicant shall appear before the learned Trial Court as and when the matter is taken up for hearing.

(c) Petitioner/applicant shall provide mobile number to the IO concerned which shall be kept in working condition at all times and shall not switch off or change the mobile number without prior intimation to the Investigating Officer concerned. The mobile location be kept on at all times.

(d) Petitioner/applicant shall not indulge in any criminal activity and shall not communicate with or come in contact with the witnesses. 5.

The application stands disposed of.

Copy of the order be forwarded to the concerned Jail Superintendent for information and necessary compliance.
