% 15.01.2019 Learned counsel for the petitioner submits that petitioner is in custody for the last more than 3 and a half years. As per FSL report, no semen was found in the vaginal swab and clothes of the prosecutrix. Learned APP submits that prosecutrix has categorically stated in her statement under Section 164 Cr.P.C. as well as in her deposition that petitioner offered her water and after consuming the same she became unconscious, and thereafter, petitioner committed rape on her. Trial is going on.
Statement of the witnesses cannot be sifted and weighed meticulously at this stage so as to doubt the veracity of their version.
Bail application is dismissed.
