O R D E R

By virtue of the present petition under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), the petitioner seeks the following reliefs: "a) Direct transfer of investigation in FIR No. 415/2022 from Police Station Jyoti Nagar to the Crime Branch or any other independent and competent Agency /department of Delhi Police, other than PS Jyoti Nagar, to ensure a fair, impartial and time-bound investigation;

b) Direct the Respondent to incorporate appropriate penal provisions, including but not limited to Sections 467/468/471/120B IPC and other relevant sections, in accordance with the Petitioner's original complaint dated 30.09.2021 and the material available on record; c) Direct initiation of registration of FIR u/s 166 A of the IPC against the concerned police officials of PS Jyoti Nagar The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. for deliberately disobeying the directions passed by Hon'ble Supreme Court of India in Lalita Kumari and shielding the actual accused by committing an inordinate delay of THREE YEARS (44 MONTHS) in delaying the investigation in case FIR No.415/2022 And;

d) Pass such other or further orders as this Hon'ble Court may deem fit and proper in the facts and circumstances of the present case, in the interest of justice." 2.

Learned senior counsel for the petitioner submits that even though the present FIR No. 415/2022 had been registered way back on 02.06.2022, despite repeated directions and orders from the concerned Court to expedite the same, the chargesheet has not been filed till date. 3.

Learned ASC for the State submits that despite best efforts, investigation of the present matter has taken some time, however, the chargesheet is underway and will be filed no later than four weeks under all circumstances.

In the wake of the aforesaid statement made by the learned ASC, learned senior counsel for the petitioners, seeks leave to withdraw the present petition with liberty to seek appropriate remedies, if as and when required, in accordance with law.

As such, the present petition alongwith the pending application is dismissed as withdrawn.
