O R D E R

% 14.02.2019 By this petition, the petitioner seeks parole on the ground of surgery of his father who is suffering from cancer which is scheduled for 19th February, 2019.

The factum of surgery had already been verified. On the last date of hearing learned proxy counsel for learned Standing Counsel for the State informed that on the same ground paternal uncle had also sought parole in which the co-ordinate bench of this Court had directed the State to find out who would seek release on parole whether the petitioner who is the son of the patient or the paternal uncle.

Learned proxy counsel for learned Standing Counsel for the State states that an affidavit has been filed by the petitioner's father in W.P. Crl. 308/2019 stating that he would prefer his son i.e. the present petitioner herein being released on parole for being available at the time of surgery and post-operative care.

Considering the facts verified and that the surgery of the petitioner's father is to be performed, this Court deems it fit to grant parole to the petitioner. It is, therefore, directed that the petitioner be released on parole for a period of four weeks from the date of his release on his furnishing a personal bond in the sum of ₹25,000/- with one surety bond of the like amount subject to the satisfaction of the Superintendent, Mandoli Jail. Petition is disposed of.
