Heard the petitioner in person and learned counsel for the respondents.

The concern shown in this writ petition, which has been filed as public interest litigation petition, is in respect of illegal encroachments, unauthorised structures, shops, kiosks, vendors and existence of chaotic electric poles on Loni Road, Road ID No. 1481 (from Loni Gol Chakkar to GT Road Shahdara). Accordingly, a prayer has been made to remove such illegal encroachments and unathorised structures and shops etc., from the said road and also to restore 45 mtr. width of the said road as per Master Plan of Delhi, 2021. electric poles from the sides/middle of the road and even from the median/divider and relocate the transformers at an appropriate place. Certain other prayers have also been made for repair of the road. 3.

The petitioner, for raising the aforesaid grievances, had sent a legal notice-cum-representation dated 13.10.2025 which has been enclosed as Annexure P-20 to the writ petition.

The Municipal Corporation of Delhi vide its letter dated 04.12.2025 has responded to the said legal notice stating therein that the work relating to removal of encroachment shall be undertaken by different departments of Municipal Corporation and further that so far as widening of the road is concerned, the said work shall be done by the Public Works Department. 5.

Our attention has been drawn to a letter dated 29.11.2025, by learned counsel representing the Municipal Corporation of Delhi, which has been written to the Chief Engineer concerned by the Executive Engineer, according to which certain steps are to be taken to widen the road. The said letter states that as per the Zonal Master Plan of Delhi (MPD-2021), the notified right of way (RoW) for Loni Road is 45 mtrs. and at present said road exists with varied widths at different stretches. The letter shows that certain discussions had also taken place for widening of the road in some meeting said to have been held on 12.11.2025. As per the letter dated 29.11.2025, the surrounding area is densely populated with a lot of residential, commercial and institutional establishments which necessitates widening of the road to erase congestion and improve traffic mobility. 6.

From the aforesaid, it appears that the Public Works Department of GNCTD is aware of the need of widening of the road and certain steps are also in contemplation, however, having regard to the concerns expressed in The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

this writ petition which is supported by what has been stated in the letter dated 29.11.2025, we direct that a survey shall immediately be undertaken for the purpose of widening of the said road. Once the survey is complete, necessary action plan shall also be prepared by concerned authorities including the Public Works Department of GNCTD, and thereafter, on obtaining the requisite administrative and technical sanction, the work relating to widening of the road shall also be initiated at the earliest. 7.

In the meantime, so far as the existing width of 45 mtrs. of the road is concerned, all concerned who are entrusted with removal of encroachments and illegal structures shall take appropriate action forthwith. The action relating to removal of encroachments/removal of illegal constructions on the road shall be initiated within a fortnight from today which shall be carried strictly in accordance with law, of course, after giving an opportunity of hearing to the persons who are said to have encroached or raised illegal constructions on the road. The action relating to removal of encroachments/illegal constructions under this order shall be completed with expedition, in any case within a period of 04 months from today. 8.

So far as the widening of the road is concerned, we hope and expect that the work will be started with expedition, if possible within a period of one year.
