This hearing has been done through hybrid mode. 2.

The present petition has been filed by Petitioner-Bhagwan Das under Article 226 of the Constitution of India read with Section 528 of Bharatiya Nagrik Suraksha Sanhita seeking issuance of a writ in the nature of habeas corpus for the production of his daughter Ms. 8X9. The Petitioner suspects Respondent No. 3 to be involved in the incident. 3.

On 14th February, 2025, the Court had directed Girl and Boy to be produced. Today, a status report dated 4th March 2025 has been handed over by Mr. Sanjay Lao, Standing Counsel (Criminal) stating that the Girl was traced to District Kanpur in the jurisdiction of the PS Gujaini, Uttar Pradesh. The Boy was, however, not found there. The Girl was medically examined and no history of violence, sexual assault, intercourse or abuse was found. It also states that the statement of the Ms.8X9 was recorded under Section 183 of BNSS, 2023 before the Ld. JMFC, Saket Court, New Delhi wherein she had expressed her wish to go back to her parents. The status report filed today is taken on record.

Today, the Girl Ms.8X9 is present in Court. She is 17 years of age. Her parents are also present. Upon the Court9s query to her, she has expressed her willingness to accompany her parents.

Accordingly, the petition is disposed of in the above terms. All pending applications, if any, are also disposed of.
