This petition has been filed seeking a mandamus to the Respondent for confinement of the Petitioner in a semi open prison in FIR No. 90/2010 under Sections 302/201/34 of the Indian Penal Code, 1860 (IPC) registered at P.S Bhalswa Dairy.

It is stated that the Petitioner has completed actual incarceration of 11 1⁄2 years and his conduct in the jail has been satisfactory. 3.

It is stated that the Petitioner has been granted furlough and parole on several occasions and he has duly surrendered thereafter. 4.

It is stated that the Petitioner works as a sewadar inside the jail and has been duly recognized for his services by the jail authorities. 5.

It is stated, however, that the Petitioner has not been considered for confinement in a semi-open prison.

meeting of the competent authority for considering entitlement of eligible convicts for confinement in semi-open prison is likely to be held in March/April 2025. He states that the Petitioner's present petition shall be considered as a representation and will be placed before the said competent authority.

In response, learned counsel for the Petitioner states that he would be satisfied if a direction in terms of the aforesaid is issued in this petition. 8.

In view of the aforesaid submissions of the parties, the present petition is disposed of with a direction to the concerned Jail Superintendent to place the present petition before the competent authority at the next schedule meeting. The competent authority is directed to consider the present petition as a representation of the convict and decide the same in accordance with law.

Pending applications stand disposed of.

A copy of this order be sent to the Jail Superintendent. 11.
