The present writ petition under Articles 226 and 227 of the Constitution of India seeks to assail the order dated 30.01.2023 passed by the learned Central Administrative Tribunal in O. A. No. 218/2019.

A perusal of the impugned order shows that the learned Tribunal has allowed the original application preferred by the petitioners by relying on its earlier decision dated 22.11.2012 in O.A. No. 2932/2011.

Taking into account the petitioners' plea that the decision in the said O.A. is already a subject matter of challenge before this Court, the learned Tribunal has directed that the award of the benefits under the impugned order to the respondents will remain subject to the outcome of W.P. (C) Nos. 13557/2009, 4377/2007, 8788/2007 & 1239/2011.

In the light of the aforesaid directions issued by the learned Tribunal making it clear that the respondents will remain bound by the decision in the aforesaid writ petitions, we see absolutely no reason to entertain the present petition. It is, however, reiterated that as directed by the learned Tribunal, the grant of relief to the respondents in terms of the impugned order will remain subject to the outcome of the aforesaid petitions. In case the petitioners succeed in the aforesaid batch of writ petitions, it will be open for them to make recovery from the respondents if the need so arises. 7.

The petition along with pending application, accordingly, stands disposed of with the aforesaid clarification.
