The bail application has been filed under Section 439 of the Code of Criminal Procedure, 1973 (Cr.P.C.) for the grant of regular bail to the petitioner, Mr. Ravi Sharma @ Rocky, in FIR No.456/2018 under Sections 354/354-D of the Indian Penal Code, 1860 (IPC) and Section 12 of the Protection of Children from Sexual Offences Act, 2012 (POCSO Act), registered at Police Station Bhalswa Dairy, Delhi. 2.

Status report has been filed wherein it is stated that there is no previous involvement of the petitioner in any other case. 3.

Learned counsel for the petitioner submitted that the petitioner has been in custody since 11.9.2018 and his conduct in jail has been satisfactory and the petitioner does not have any criminal antecedents. Learned counsel for the petitioner further submitted that the prosecutrix has already been examined by the Trial Court.

Learned counsel for the petitioner prayed that in view of the aforesaid facts and circumstances and the fact that the trial of the case may take some time, the petitioner may be admitted on bail. 5.

Learned APP for the State also stated that the prosecutrix has already been examined and no other public witness is required to be examined now.

Taking into consideration the aforesaid facts and moreso the fact that the prosecutrix has already been examined by the Trial Court and the fact that the trial of the case may take some time and the petitioner is having no criminal antecedents, I deem it appropriate to admit the petitioner on bail during the pendency of the trial, subject to his furnishing a bail bond in the sum of Rs.25,000/- with one surety of the like amount to the satisfaction of Trial Court. It is directed that the petitioner shall not, in any manner, contact the prosecutrix or any witness.
