The present Appeal has been filed under Section 10 of the Delhi High Court Act, 1966 read with Order XLIII Rule 1 of the Code of Civil Procedure, 1908 assailing the Judgment/Order dated 21.12.2022 passed by the learned Single Judge in TEST.CAS 79/2015 captioned Dharam Vir vs. State.

On 28.01.2025, a Coordinate Bench of this Court passed the order, reproduced hereinbelow:

"1. Learned counsel for the objector submits that he has not received the copy of the paper book.

2. Learned counsel for the appellant undertakes to supply The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The Order is downloaded from the DHC Server on 27/09/2025 at 11:47:03

the same to the learned counsel for the objector within two days.

3. List on 21.03.2025."

Even after passage of almost 09 months, learned counsel representing the Appellant has failed to supply copy of the paper book to the learned counsel representing the Objector. 4.

Today, when the counsel was called upon to supply the copy of the paper book, he refused to do so.

Hence, this Appeal, along with pending applications, is dismissed for non-prosecution.
