This hearing is being conducted through hybrid mode. REVIEW PET. 222/2025 -FOR REVIEW OF ORDER DT. 03.03.2025 in CONT.CAS(C) 234/2025 2.

This is an application moved on behalf of the applicant/petitioner for recalling of the order dated 03.03.2025. 3.

Learned counsel for the respondent/MCD is present on advance notice.

It is submitted by learned counsel for the respondent/MCD that on the receipt of the complaints lodged at the behest of the petitioner, appropriate action has been taken as against a total of 18 properties in Delhi in accordance with law.

An enquiry needs to be done to ascertain the underlying objectives of the petitioner in filing the instant contempt petition. 6.

In order to inquire and ensure that the process of law is not being misused or abused for any ulterior motives, in terms of the order passed by a Co-ordinate Bench of this Court in the case titled Sudeep The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Kumar v. South Delhi Municipal Corporation of Delhi2, the same dictum was followed by this Court in a subsequent case titled Pratap Singh Parmar v. DDA3 and further in view of the observations made by a Division Bench of this Court in the case of Ms. Preeti v. MCD4, the office bearers viz., the President & the Secretary of the petitioner/association are directed to file an affidavit within four weeks from today with respect to the following aspects: (i) details of the members of the petitioner organisation including their occupations and education;

(ii) source of their income & earnings of each members of the petitioner with certified copies of their bank accounts maintained by them for the last two years;

(iii) information be furnished regarding the number of petitions that have been filed by the petitioner in the past five years in any Court of Law in the nature of Public Interest Litigations ["PIL"] or otherwise, and (iv) furnish information as to in how many matters he has withdrawn prosecution or has settled the matters with the opponent parties and if so on what terms, which as per them, raised or intended to raise/carry out unauthorised construction and/or encroachment on any public land;

(v) the distance between the house of the members of the petitioner and the house in which unauthorized construction is alleged;

(vi) to disclose whether there is any unauthorized construction carried in the houses of the members of the petitioner and/or whether the construction of houses of its members are as per the sanctioned plan.

It is specifically directed that the affidavit of Mr. Ranjeet Kumar Chaudhary, through whom the present appeal has been filed, should be filed within the time stipulated besides its other members. 8.

Let a copy of the petition be supplied to learned counsels for the MCD and DDA, who shall be at liberty to file a reply within six weeks from today.
