% 28.02.2018 By this petition, the petitioner seeks setting aside of the order dated 11.08.2017 whereby the application of the petitioner/prosecution under Section 311 Cr.P.C. was dismissed. Learned counsel for the petitioner submits that pending the present proceedings, the respondents have been acquitted by the Trial Court. He further submits that the petitioner is in the process of filing an appeal impugning the said order. He prays for leave to withdraw the petition, with liberty to raise the pleas raised in this petition before the appellate court.

In view of the above, the petition is dismissed as withdrawn, with liberty to the petitioner as prayed for. SANJEEV SACHDEVA, J FEBRUARY 28, 2018/av
