O R D E R

% 21.02.2019 Learned counsel for the petitioner submits that petitioner is in custody for more than two months. In her statement under Section 164 Cr.P.C., prosecutrix has not levelled any allegation of rape against the petitioner. Prosecutrix married petitioner on 10.12.2016. Date of birth of prosecutrix is 15.07.1998 meaning thereby that even at the time of marriage she was major. It is prayed that petitioner may be enlarged on bail. Learned APP opposes the grant of bail to the petitioner. It is contended that a child was born on 09.03.2016 prior to the marriage of prosecutrix. FIR was initially registered under Section 363 IPC on the complaint of father of prosecutrix.

Keeping in mind totality of the facts and circumstances of this case,

petitioner is admitted to bail, subject to his furnishing a personal bond in the sum of `10,000/- with one surety in the like amount to the satisfaction of the trial court.

Bail application is disposed of in the above terms. Dasti.
