O.M.P.(MISC.)(COMM.) 146/2025 1.

This Petition under Section 29A(4) & (5) of the Arbitration and Conciliation Act, 1996 has been filed by the Petitioner for extending the mandate of the Arbitral Tribunal.

Material on record indicates that the Petitioner was awarded a contract by the Respondent for the work of Design, Engineering, Procurement, Installation, Pre-commissioning, Assistance to commissioning and assistance to Performance Guarantee Test Runs in the designated units of the Respondent. Since disputes arose between the parties, a Tribunal was constituted by this Court on 13.03.2019. Pleadings stood completed in December, 2022. February, 2023. It is stated that the parties extended the mandate of the Arbitral Tribunal by mutual consent for a period of six months from February, 2023. It is stated that a petition being O.M.P.(MISC.) (COMM.) 119/2024 was filed by the Petitioner before this Court for extension of the mandate of the Arbitral Tribunal which was allowed by this Court on 20.02.2024 extending the mandate of the Arbitral Tribunal for a period of one year from 24.02.2024. The mandate of the Arbitral Award is going to expire on 24.02.2025.

It is stated that rejoinder arguments stands concluded and the award has been reserved for pronouncement.

Learned Counsel appearing for the Respondent states that he has no objection if the mandate of the Arbitral Tribunal is extended. 5.

In view of the facts of the present case, this Court is inclined to extend the mandate of the Arbitral Tribunal till 30.09.2025, so that the award can be pronounced.

The Petition is disposed of, along with the pending applications, if any.
