% 19.02.2019 Notice. Learned APP for the State accepts notice. By this application the petitioner seeks bail in case FIR No. 56/2018 under Sections 354/354D/411/506/34 IPC and Section 10 of the Protection of Children from Sexual Offences Act (in short POCSO Act) registered at PS New Friends Colony.

The allegations of the victim in the above-noted FIR and her statement recorded under Section 164 Cr.P.C. are that on 6th March, 2018 while she was going to take milk in the evening, suddenly the petitioner who is residing in her neighbourhood came from behind and touched her shoulder. Petitioner insisted on talking to the complainant and when she refused that she would not talk to him, he threatened her by showing a blade. The victim started screaming resulting in public persons gathering there whereafter the petitioner ran away after leaving the blade at the spot. BAIL APPLN. 98/2019

The petitioner is in custody since 3rd April, 2018 and after framing of charge the victim has since been examined before the learned Trial Court. In view of the fact that the victim has already been examined before the learned Trial Court, this Court deems it fit to grant bail to the petitioner. It is therefore directed that the petitioner be released on bail on his furnishing a personal bond in the sum of ₹25,000/- with one surety bond of the like amount to the satisfaction of the learned Trial Court, further subject to the condition that in case of change of residential address the petitioner will intimate the same to the Court concerned by way of an affidavit. Petition is disposed of. Order dasti.
