The present petition has been filed by the petitioner under Article 227 of the Constitution of India, 1950, assailing the order dated 18th February, 2026, passed by the trial court in CS (Comm.) No. 579/2021, whereby the suit filed by the petitioner was dismissed in default for non-prosecution and nonappearance. 4.

After some arguments, learned Counsel for the petitioner seeks leave to withdraw the present petition with liberty to approach the trial court for moving an appropriate application for restoration of the suit.
