By way of this petition under Section 11 of the Arbitration and Conciliation Act, 1996, the petitioner seeks appointment of an arbitrator to adjudicate disputes between the parties under an agreement dated 17.08.2023.

The petitioner relies upon clause 15 of the agreement which reads as follows:- "15.

In the event of any dispute arising under this agreement, either the said dispute will be referred to sole arbitrator whose decision will be final and binding on both parties or the courts of Delhi shall have jurisdiction."

After some hearing, Mr. Krishan Kumar, learned counsel for the petitioner, seeks liberty to withdraw the petition with liberty to take alternative remedies.
