% 24.01.2019 Mr. Peechara, learned counsel for respondent no.1/ NDMC submits that the present petition filed by the petitioners is a gross misuse of the process of the Court. It contains false averments to the extent that all the petitioners are not in the list of 628 street vendors prepared by the NDMC and only 15 persons are in the said list. Additionally, he submits that a survey has already been conducted with respect to those petitioners, whose names are in the list of 628 street vendors.

At this stage, Mr. Sharma, learned counsel for the petitioners wishes to withdraw the writ petition.

As prayed, the writ petition is dismissed as withdrawn. The counsel is cautioned to be careful while making averments in the writ petition in future, which are not factually correct, failing which a serious view shall be taken in the matter.
