The present writ petition has been filed seeking quashing of the NOC/Permission granted by respondent-MCD in favour of respondents no.11 and 12 on 23rd January, 2026 for permitting installation of lift in flat no. 48C and 49C of the DDA C4A Block, Janakpuri, Delhi-110058 ('subject property').

It is contended that the installation of lift would result in encroachment on the public area.

Status report has been filed on behalf of respondent-MCD. A copy of the same has been handed over in Court and is taken on record. 4.
The status report filed by the MCD states that: i.
Based on a complaint from the petitioner with regard to illegal construction of lift, the property was inspected and it came to notice that the proposed lift is at a public place (common passage). ii.
Accordingly, a Show Cause Notice has been issued on 16th March, 2026 for revocation of permission/NOC for installation of the subject lift. Reply to the aforesaid show cause notice had been filed on behalf of respondents no.11 and 12.
iii.
A further Show Cause Notice has also been issued on 24th February, 2026 for unauthorised construction in the form of third floor at the subject property.
