Learned counsel for the petitioner, after some arguments, submitted that she may be allowed to withdraw the petition with liberty that the observations made in the impugned orders dated 8.8.2018 and 5.1.2019 passed by the learned Metropolitan Magistrate and the Appellate Court, respectively, shall not tantamount to any expression on the merits of the case while disposing of the main petition pending before the Trial Court.

Accordingly, the petition is dismissed as withdrawn. CRL.M.A.946/2019 is also dismissed as withdrawn. 3.

It is clarified that the observations made in the impugned orders dated 8.8.2018 and 5.1.2019 passed by the learned Metropolitan

Magistrate and the Appellate Court, respectively, shall not tantamount to any expression on the merits of the case while disposing of the main petition pending before the Trial Court. 4.

The Trial Court is directed to decide the main petition, on the basis of evidence, documents proved on record and as per law as expeditiously as possible.
